Precautionary measures for even the best laid plans
How assets will be distributed on the dissolution of a marriage or breakdown of a relationship
Protecting your interests going into a marriage may not seem romantic and quite possibly the last thing you may want to think about before a wedding but it is a sad fact that there are approximately 132,562 divorces in the UK annually (2006).
The Law relating to agreements made before marriage, and your wedding, (prenuptial) is changing and developing rapidly. The trend is for the Courts to show an increasing willingness to respect prenuptial agreements freely entered into between the parties.
Why choose a Prenuptial Agreement?
A Prenuptial Agreement drawn up by solicitors can:
- Reduce some of the uncertainty of marriage breakdown
- Provide for a more harmonious relationship.
- Give you extra peace of mind
- Take the worry out of your financial future
- Ensure that your financial concerns are addressed
- Protect you against the cost and uncertainties of matrimonial litigation.
Prenuptial checklist
We can advise you on the most appropriate course of action in this instance with our family legal team.
The following useful checklist outlines the questions we will need to ask you at an initial meeting:
- When are you getting married?
A prenuptial agreement will need to be finalised 28 days before the wedding. - What did you own before?
We will need to know what assets yourself and your partner had before the relationship began. - What do you own now?
We will also need to know what assets you have now, both jointly and individually. - Any children?
We will need details of any children living with you.
