Collaborative Law
Collaborative Law is a new way of approaching family disputes and marriage breakdown. It involves ‘four-way’ face to face meetings with your estranged partner, his or her solicitor and your own solicitor.
This differs from mediation, as a mediator is not a legal representative and would advise you to take additional legal advice. With collaborative lawyers, your legal advisor is always by your side.
If you are going through a separation, what are the benefits of the Collaborative Law approach?
Avoids the heartache and cost of court. Your solicitor will sign an agreement to disqualify him from representing you in court – giving you an incentive to sort things out face to face.
You are in control. After an initial discussion with your solicitor, you can set the agenda of the meeting. Because there is no timetable, you are not tied to the schedule of the court and you can also set the pace. This is obviously important if there is a property to sell.
Important issues can be discussed face to face. As opposed to costly telephone calls and correspondence between your solicitors, critical issues such as finance, the welfare of any children and all your priorities and concerns can be discussed over the table.
Helps to maintain an amicable relationship. If you have children, you will always be their parents and this process enables you to communicate effectively for their sakes.
